Terms of Service

French is the authoritative version of these terms. An English version is provided for convenience. By accepting these terms you confirm the French version was made available to you and that you chose to proceed in English.
1. Who these terms are with
These terms form an agreement between you and Sedlex Services Inc., 1100, avenue des Canadiens-de-Montréal, Suite 354A, 3e étage, Montréal (Québec) H3B 2S2 ("Püper", "we", "us").
2. Accepting these terms
By using the Püper application or website you accept these terms. If you do not accept them, do not use Püper. You must be at least 14 years old, or have the consent of a person having parental authority.
3. What Püper is — and what it is not
Püper is a community-contributed directory of publicly accessible restrooms. Listings, ratings, access-type designations, amenities and reviews are supplied by users, not verified by us.
- We do not guarantee that any restroom exists, is open, is accessible, is clean, or may be used by you. Information may be outdated or wrong.
- An access-type badge is not permission to enter. A "Public" or "Customers" designation reflects community reporting only. You must always respect the rules, hours, staff instructions and property rights of the establishment.
- Püper is not a medical or emergency service. Do not rely on it in an emergency or in place of medical advice.
You use Püper at your own judgment and are responsible for your own conduct on premises you visit.
4. Your account
Provide accurate information, keep your credentials secure, and do not share your account. You are responsible for activity under your account. Tell us promptly at contact@puperapp.com if you believe it has been compromised.
5. Your contributions
You keep ownership of what you contribute. By contributing, you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable licence to host, store, reproduce, translate, adapt, publish, publicly display and distribute your contribution as part of the Püper database and for promoting the service. To the extent permitted by law, you waive your moral rights in your contributions in our favour and in favour of our licensees. You confirm you have the right to contribute the content and that it does not infringe anyone's rights. Because contributions form a shared community resource that others rely on, a listing you created may remain in the database after your account is deleted, in de-identified form.
6. Rules of use
You must not: submit false, misleading, or deliberately inaccurate listings or ratings; post content that is harassing, hateful, defamatory, obscene, or unlawful; include personal information about identifiable third parties; scrape, bulk-extract, mirror or resell the Püper database; use the service or its data to build a competing product; circumvent, disable or interfere with premium feature gating, rate limits, or security measures; access the service by automated means without our written permission; or use Püper for any unlawful purpose.
7. Moderation
We may review, edit, refuse, or remove any contribution, and suspend or terminate any account, where we reasonably believe these terms have been breached or the integrity of the database is at risk. Where reasonable, we will tell you why.
8. Püper Premium
Price and term. Püper Premium costs $4.99 CAD per month, taxes extra where applicable. It renews automatically each month until you cancel.
Seller of record. If you subscribe on the web, your contract for payment is with us, processed by Stripe. If you subscribe through the Apple App Store or Google Play, your purchase is billed by Apple or Google under their terms, and cancellations and refunds for that purchase are handled through that store.
Cancelling. You may cancel at any time; cancellation takes effect at the end of the current billing period and you keep access until then. We do not provide partial-month refunds except where the law requires it.
On lapse. When a subscription ends, premium features stop and any location stored for real-time alerts is deleted.
Price changes. We give at least 30 days' notice before any price change takes effect, and you may cancel before it applies.
Free features. Core restroom search and discovery are free and we intend to keep them free.
9. Your rights as a consumer
Nothing in these terms limits the rights you hold under the Quebec Consumer Protection Act or other applicable consumer legislation. In particular: we do not require you to arbitrate disputes, and nothing here waives your right to participate in a class action; you may bring proceedings before the courts of Quebec regardless of any other provision; the legal warranties that cannot be excluded under Quebec law continue to apply.
10. Changes to these terms
For any amendment affecting a subscription, we will send written notice at least 30 days before it takes effect, setting out the new clause, the clause as it read before, and the date the change applies. You may refuse the amendment and terminate your subscription without cost, penalty or cancellation indemnity by notifying us before the change takes effect. For non-subscription changes, we post the updated terms with a new effective date and, where material, notify you in the app or by email.
11. Third-party content and maps
Map data comes from OpenStreetMap contributors under the Open Database License. Map tiles, geocoding and routing are provided by third parties. We are not responsible for the accuracy of third-party data or the content of sites we link to.
12. Our intellectual property
The Püper name, logo and the design of the applications belong to Sedlex Services Inc. These terms give you no right to use them. Trademark applications are pending.
13. Availability
We aim to keep Püper available but do not promise uninterrupted service. We may modify, suspend or discontinue features. If we discontinue the service entirely, we will give reasonable advance notice and will not charge for a subscription period we cannot deliver.
14. Limitation of liability
To the extent permitted by law, our total liability for all claims arising from your use of Püper in any twelve-month period is limited to the greater of the amounts you paid us in that period and fifty Canadian dollars. Nothing in these terms excludes or limits our liability for bodily or moral injury, or for our intentional or gross fault.
15. Ending this agreement
You may stop using Püper and delete your account at any time from within the app, or by writing to contact@puperapp.com. We may terminate or suspend your access for breach of these terms. Sections 5, 12, 14 and 16 survive termination.
16. Governing law and language
These terms are governed by the laws in force in Quebec. Subject to section 9, the courts of the judicial district of Montreal have jurisdiction. The French version of these terms prevails in the event of any discrepancy.
